Honestly it doesn't sound right to use a social security card of another and get charged with petit larceny but we'll see. I hope its 102 precinct, Identity theft. We're all quoting the guide etc but we must realize that nothing was really straight forward. Every question had about 2 different sections tied together and had a trick to it so we had to figure out where it met in the middle.

its not identify theft, its petty larceny, because identify theft/petty larceny is considered petty larceny, both are misd and petty larceny comes first in the penal law. Second, look it up in the complaint reporting guide, i did, since the charge was done over the internet and the amount was less than $500 it is considered petty larceny. If the amount is $500 to $1000 it goes to identity theft. If it was over $1000 using phone or internet it is grand larceny. IF the physical card was used to make purchase the amount doesnt matter and it is grand larceny. BUT again in this question it was done over the internet. The answer is unfortunately petty larceny.

The dollar amount isn't relevant to the question. Here is what I remember and then you guys fill me in with the rest. A guys wants to make a complaint regarding a credit card that was opened in michigan under his name. That card was used to make two separate purchases of 500 bucks each. That's all I remember. Now can anyone tell me, were those purchases made over the Internet/phone or were they made in person. 2) was the purchase made in NYC or outside the city? 3) were the purchases shipped to NYC? If anyone can remember that would be a big help and I can finally get the right answer.

Ok since nobody can give me the question, I will type word for word the different meanings of ID Theft and Larceny offenses as stated by the crime complain reporting system reference guide as of june 2011.

Personal Identification information used to obtain a credit card for which the victim did not apply. Credit card sent outside NYC and charges made in NYC with physical credit card= Grand Larceny in the NYC pct where the victim resides.

Personal Identification information used to obtain a credit card for which the victim did not apply. Credit card sent outside NYC and charges made in NYC via phone or internet = 1. Grand Larceny if > $1,000 or 2. Petit Larceny $1000 or less, or ID Theft (Determined by dollar amount) in the NYC precinct where the victim resides. When multiple purchases are made throughout NYC, said precinct will classify complaint report according to the aggregate dollar amount of all purchases in NYC.

Now can anyone remember how the question was actually phrased? Please help out. I have the book that can spell it out, I just need help clarifying the actual question.

the dollar amount is most certainly relevant, and i posted earlier what it was. I have the crime complaint guide in front of me, here is the page number for people who still refuse to believe. geez. Page 33 . I will take a picture of it and post it after my phone charges. ITs petit larceny for the 100th time. Was less than $500 and was made over the internet.

Thank you, at least some of you guys respond. It's just hard to get a straight answer when I don't remember how the actual question was phrased. I have the actual guide in front of me too. No need to take a picture of it. Pages go from 33 to 47. Thanks though.

I do remember it was separate purchases. It wasn't just 500, it might have been 2 purchases of 500 each. Which wouldn't matter because it would have needed to be 1001 or more to be classified as Grand Larceny.

it was one purchase for $400 and the other was like $30 it was definitely under $500, but yes doesnt matter, because u need over $1000 for grand larceny in this question.
