well city finally responded and well it was full of lies and b.s . my final brief is going in and judge will make up his mind supposedly wihin the next 60 days. it could be more it could be less.

well not to get into to much detail ,ive never had a bad eval just a pos c.o about 5 years ago . well i did have an unauthorized sheld pin on my shield backing at roll call . well the city did pull the 1 in 3 rule out of there pocket . although i am not aware of anyone who has challenged it and further still, every situation is unique and mine is . the 1 in 3 rule the way its written states not that the city can promote who they want with impunity. its states that they can skip 2 canidates and promote the 3rd. it doesnt mean you can promote a whole list ,minus 1 person . thats an excuse and i believe given my circumstances and its clearly obvious and exposes the coruption that exists at the top when they want to single someone out. Again ive found tons of articles from various unions claiming that this rule is biased corrupt, favors neopitism, and has been used to single people out someone may not like and screw them over. Im hoping that the judge that is gonna have this case, see's how abused the rule is and once and for all kill the rule once and for all. past case law ive seen have won and some cases promoted (other unions) and other cases financialy compensated and in the words of the courts "made whole again" . should the judge rule the case has merit to proceed im pretty sure the offer will role in from the city. like ive said in the event something happens ill propably also get an offer plus a silence claus .so if i dont say much else youll understand. p.s just for the record im not looking to be a problem child and get off taking on the system or any other negative stigmatism. ill say this in my defense if i was i would have gone to a lawyer teh second i was skiped on jan 2 2008 . instead of when the list was killed. oh and just a little funny note the city stated that i cant be promoted because 2 listes cant exist at the same time. which the city did already for both the 2007 and 2008 test. so they also set a precedent for doing it. so we will see what happens.

I think it's great what your doing. It takes time and courage to do what your doing and in the end I'm sure this process will help to change (even if just a little bit) the way this job does things. Keep going show no fear and you will win in the end ! 

blondie i wish you the best of luck...but i just don't understand. Why you?? Why would the city just arbirtrarily choose not to promote you? As an outside observer it seems like there must be WAY more to the story than you are revealing here. Why is there such a beef with you? Just curious.

Well all the briefs are in and now its in the hands of the judge . The waiting continues, my case is solid and if my judge is a fair minded man i should get at the minimum a trial . Im hoping the judge rules in my favor right of the bat and orders both sides in for a settlement meeting. There is a good chance ill be having to sign a shut my mouth agrement at that point . So there is a good chance this could be one of the last posts in reguards. There talking about the possibility of if they cant promote me to sgt . As a "POSSIBLE" offer on the table is 2nd grade detective. I still personally feel even with that offer i wont be happy . So ill propably only take it if there is no other option. I might go with a money offer and stay a cop for my last few years . Who knows well see in the coming weeks or months. The judge has upto 60 days, but almost no judge does it that fast. I guess the waiting begins again . i hear there is another test scheduled for sept of next year ? I propably wont even bother persoanlly ill have 16 1/2 on the day of the exam and 17 1/2 or so when the list comes out . Then to get run over the coals again and put in another holding pattern ill see what mood im in when the test is announced. At any rate those are issues for another day.

yeah i figured there wasnt . rumor around my command was there was one supposed to be scheduled in sept of next year.

10-4 fair enough. i personelly thought b.s my self with 1 test still in the wind how could they possibly be thinking of another one.

thanks for asking nycop80 not much more then post number 108. currently in a holding pattern awaiting the judges decision. Im really hoping for a fair judge and so far its looking that way but time will tell.
