tommorow the 2013 captains list comes down. and the 2012 list still has 21 names left on it which translates to months left on promotions. They are not and will not cut that list. So like I've always said new lists wait for old lists to finish It does not matter what a civil service "law" says. It's up to the dept what is done and always will be. I'm sure most of you know this but to the few that are still confused.
No idea why people think it automatically MUST terminate... nor do I understand why people think that it MUST last for 3 years or something. Minimum is 1 year, Maximum is 4.
4.6.6. Duration of Eligible Lists.
(a) The duration of either an open competitive or promotion eligible list shall be not less than one nor more than four years from the date of establishment.
(b) Unless otherwise provided, an eligible list which has been in existence for one year or more shall terminate upon the establishment of an appropriate subsequent like list for the same title.
(c) Where the duration of an eligible list is fixed in the announcement of examination at less than four years, the commissioner of citywide administrative services may by resolution prior to the expiration date of such list extend the duration of such list up to the maximum limitation of four years, provided that such announcement of examination states that such extension may be made.
(d) The commissioner of citywide administrative services may also by resolution prior to the expiration date of an eligible list extend the duration of such list as provided for in section fifty-six of the civil service law, as amended by section one of chapter four hundred and forty-three of the laws of nineteen hundred and seventy-six.
So yeah, I think you're right. If the commissioner of DCAS wants to have 2 lists in existence, it's allowable I believe under (b)... key phrase being "unless otherwise provided".

If true, its pretty interesting that they would release the 2013 Captain info before the Sergeant info as the Sergeant exam was a month earlier. I understand that the volume is much, much greater, but all the grading and protests should be completed by now.
People hang on these civil service laws as a way to fit their argument. A list isn't "active" until it starts being promoted from. Yes, a list CAN be active for 1-4 years. If what most posters say is true, the 2009 list was published but wasn't promoted from for almost a full year.
So even if the 2013 Sergeant list comes out tomorrow as well (for argument sake, no real info here), the 2011 list doesn't automatically end. They can and very most likely will promote everyone off of it. That being said, I know I'd be pooping bricks worried of the 2011 being cut if I was 1400+!
Lmao why is this still a conversation ?? This whole list is gonna get made and then the 2013 list is just going to have to wait like every other list to be made. It's that simple.
