lawyer

Guys, we obviously have to wait and see if we pass and how many people will be in on an (expensive) lawyer, but if you want, I can reach out to a few (I am in my third year of blood sucking um ah law school). A lawyer would love to take this case, and spin it into some kind of disadvantage issue (race based test). Look at all the news with fdny and the stamford ct fd test. Let me know what you think, but I know that's how they will spin it, turn it into a consititutional race issue. Not sure if them not giving us the management book is as good press......

Best bet is to get as many questions thrown out. Not the test itself. I aint studying again for that sh!t! Ill gladly take a 70% and get made eventually

If there's going to be a bunch of throw outs than who knows how long the list is going to be and 70 might not get you anywhere.

Look at the current lt list! There up to around that number. For this test the score means nothing. Its the amount of sgts that passed that means something.

Getting a 70 to make the list would be great, if they threw questions out. But look at the last list, you will die on it.

People have to decide what would be better, throw out the exam or or those whack questions thereby creating a long list

If the list is 700 or less and is 5 years long everybody should get made

How do u figure 1000+? this was the hardest exam given ever. Even harder then the captains exam which had 15 throw outs. There list was not big by anymeans. I believe it was just a tad over 120 names.

The firm of Dewey, Cheatham, and Howe will gladly take the case.

That firm sounds familiar....all joking aside I have to look in my "corp counsel" folder. If they are suing the city in any case where any of us are witnesses, defendants etc it would be a conflict of interest

Guys, before we hire a law firm, what's the track record of Dewey, Cheathem and Howe?  Do they specialize in civil service law?

Looking at their website, it seems they speacialize in divorce and corporate law

I've contacted Mr. Sheerin he specializes in New York City Civil Service Commission cases, and spoke to his secretary. She stated that she have already received several calls from mos who would like to initiate a case action lawsuit. She took down my information and hopefully we will be able to get a meeting so he can hear us out and see if we have a case.

I dont know why people do not believe this exam doesnt have a shot at not getting thrown out. There is a reason why on all prior exams they lock you into specific patrol guide questions for most of the test, and there is a reason why they do not have logic/leadership questions in the past.

Did you have trouble with the grammar questions?

I don't know if it is possible, probably not but if we have enough guys to go forward with the class action where the cost is not to high for each person that we are going to do so.

Yes, but much more Sgt.'s signed up for this test compared to the amount of LT's that signed up for the Captain's test.  However, I DO NOT think this list will be 1000+

A lot of members were totally confused and upset by the direction DCAS and the department took with regards to this exam. Alot of you are angry now and want to fight back, and I think you all have the right to angry and upset, especially those who put their lives on hold and studies hard.

But I wonder how many of you will still be willing to fight once the official answer key comes out and realize that you actually may make the list? Judging from the prior lieutenants exam making the list does not guarantee that you will be promoted. How many of you will look past it all and realize that there were serious issues with this exam and still fight?

The Vulcan Society of the FDNY won a court case in federal court because many questions on their entry level and promotional exam mirrored that of a SHAT exam and did not reflect their actal rules and regulations or job description/duties of a fireman. Even though part of the basis for the lawsuit was based on discrimination, if you read through the actual court document, you will see that it was about more than that.

The agency that took on this case was The Center For Constitutional Justice located at 666 Broadway, 7fl. 212-614-6464 and the lawyer was Darius Charney.

I will share this link with you all and you be the judge. http://www.justice.gov/crt/spec_topics/fdny/documents/doc_385.pdf

I did not read the entire document but it started getting interesting by page 10 and the final decision.

I hope in spite of this fiasco, a lot of you will not only make the list but also get promoted.

Good luck and happy reading
