Just starting a new thread for people to post any new info about both lists. Tired of reading through all the name calling on other threads. I'm in the 400's on test 7508.
if your list number has been passed due to not having 5 years on the job can you be killed on a list? can they not promote you because of seniority after letting you take the exam ? and where do you find this definitive answer? DCAS? Labor Relations?

Time required is an eligibility factor. If they pass you bc of not having time means you were not eligible. I was told they do not have to come back for you, when a class goes in, they start from the top of the list and check the names still remaining. But if there is no class there is no class I was in the same boat.
There are three requirements to be eligible for promotion....college credits, 5 years of service, and a passing score on the exam....all being equal...if you do not have all three, the job has no obligation to wait for you to become eligible for promotion...so yes you can die on the list.
Negative k.... u cannot die on the list due to of lack of time if they already skipped ur list #. that is a lawsuit. you r required to have 3 years on the job to take the test so that requirement was met and they cannot hold lack of time against you! however if u have less than 5 yrs and your list # HAS NOT been called yet then u can die on the list. BIG DIFFERENCE!
Keep in mind, if they passed you due to lack of time BUT you have or had some "issues" that have not been cleared by the expiration of the exam, you will die on that exam. Lawsuits will not make a difference.
People fail to realize their is always more to someone's story than they are willing to be forthcoming with. If you had initially been passed over due to lack of time but then met the time requirement and still passed over, you can bet in all probability they had "issues". The dept does not arbitrarily decide not to promote you when you meet all requirements.
If you didn't have college credits and they passed you and the list dies. Ur done. Why do you think it would be different for time. All things equal.
b/c not having enough credits is the cops fault. however being skipped for not having time on is not the cops fault. why would the job say you need 3 yrs on to take the test if they can just not promote you due to lack of time after being skipped? if thats the case the job would say only people with 5 yrs on can take the test.
Like excessive force mention, when you signed up for the exam, it clearly states on the NOE you are required to have a minimum of 60 credits for promotion.
Whoever allows college credits to be a factor in not getting promoted had ample time to get the required credits needed to meet requirements. They had atleast a year, if not more, from the time they announced the exam was being given, date required to sign up, took the exam, found out their score and the time it takes to get to their list number, to get your college credits inorder.
Shame on the person for allowing this to hold you back. They could of easily gotten credits from FEMA or thru excelsior.
It also states in noe that u are eliglible for promotion only after completion of 5 years of service. Time credits and jam ups are all conditions. U need to have all 3 if u can help it or not. I don't see them going back for you bc of service time. It's clearly written. Your placed on a candidates list bc you passed, not bc u are eligible. Any mos can take the exam, if u have less than 3 you will not be considered. The 3 year to take the exam, not sure. Maybe u needed 3 years to be promoted at one time? Either way, I hope I'm wrong. Now we are having an exam every year, 70 minimum imposed and barely anyone passing, the dept goes through the list in heart beat.
Also, way back when, you could have been promoted at 3 years but that was years ago.

The exam expires 2 years from the date the list is populated, which is usually what 2 months after the actual exam date but you have to have 3 years on when you take the exam. So you had 3 years when you took the exam, you most definitly will have the time requirement when the exam expires.
I can be wrong but the exam is populated approx 2 months after the actual date of the exam, after questions are challenged and thrown out but considering we are having an exam every year now, we don't see the actual list until much later when the previous exam is about to expire. The dept already knows how many actually passed and that is indicative if they will need to give another exam the following year. The number of people passing lately, the dept can promote within a year. It's not like 1,000's are passing, if that was the case, the list would come out sooner rather than later and we would have fewer exams.
I am not sure about the rules but I believe their maybe a time limit on having 2 exam lists being active at the same time.
6513 expires in March 09 and the exam was given in January 07.

Hey excessiveforce, introduce me to someone who has won that lawsuit and I'll introduce you to the Easter Bunny. If you do not meet the requirements..(including 5 years of service) and your list expires you are S.O.L. (that does not stand for Special Ops Lieutenant either..haha)
they cant promote any one off of the new list without going back and promoting those that are now eligible AND cleared for promotion off of the old list.
They can promote off of both lists at the same time.
Once they promote the people that have now become eligible on the old list, they can expire the old list as long as the list is 1 year old.
remember the rule they can hire off of the new list as long as less than 3 eligible candidates are on the old list, and thats exactly what they did. no one was eligible from the old list, they promoted off of the new and then went back for the old list eligibles.
even as each class happened and one guy or 2 guys became cleared off of the old list they promoted them.

The automated DCAS phone number states that list number 7508 was established 9/10/2008 and the list terminates 9/10/2012
I assume the termination date can be Jan 2010 (prior to 9/10/2012) when the last person on the list (number 671) has been called AND the people that were skipped because they did NOT have 5 years on become eligible (that would be hire dates of January 2005).
Hopefully they keep the promotions going at a fairly good rate. When BMOC was every other month the class sizes were about 50 people I think.
Disregard what I have said previously, spoke with someone today and it is 4 years, the dept has the right and discretion to expire an exam at their will. Their is the question on having 2 exams active simultaneously. It seems due to having an exam every year, they have expired exams within 2 years. 6513 will expire in March and unfortunately, the likelihood of anyone else being hired off of 6513, who isnt currently in BMOC, is not likely.
Cat usually by Wed a week before the BMOC puts a class in you have some insight. So can we assume that since you have made no post with a date no BMOC class for Feb.?
Hazardous i think u probably have just created a shiit storm with that last line. I dont believe I have nor do I think those who are left would be completely shocked if it is the case, only because, that has been somewhat definitive since the Jan BMOC went in. Not that anything is ingrained in stone but Jan class is supposedly filled with all that was passed over from 6513 plus I believe 3 others that were already promoted but hadn't gone through bmoc for other reasons. I believe the next class will be in March, skipping Feb, which would go back to someone else's statement of every other month having a bmoc class.
I hate to see people who studied and passed die on a list, but realistically, with approx. 500 eligibles waiting on 7508 and another test coming up, Id say 6513 list is done. Why would they go through a BMOC with only 19 people and leave a handful....
very simple no reason other then to mess with people ,plus there is 1 person who is out sick untill the end of feb .they wont kill the list and are leaving people on it that they need to justify keeping it active so everyone gets promoted.

I second that. I'd like to thank Commissioner Kelly, Insp. Jones and the entire CARB team for doing what was right. She deserves to be fired, never mind getting promoted. Believe me signmy28, they know they are saving this department future headaches. She will never, ever get promoted, PERIOD! IT'S A RAP!
I feel bad for the cops being sent back to their commands after BMOC ( I know it's been done before) and not being promoted until end of Feb. The only difference between them and their Sgt. is they didn't walk accross the stage yet....Sad!
Oh and what ever happened to the rumor of the new Sgt's starting at the 3rd tier? Has any new Sgt's seen the increase?
double h, i would very much well like to know that info, since top pay cop makes more than me right now. I am hearing a rumor that something in the spring is going to settle this issue.
Well I'm not made yet, but for all future Sgt's I hope something is done. Not only do new Sgt's make almost no OT but their starting pay is to close to a top pay cop.

It's not a rumor! start at $76,000 third tier, you will make $1,000 more than cops top pay, until the SBA clears this issue with the city in a new contract.
